La Consulta ha anticipato il verdetto previsto per febbraio dichiarando legittimi i tagli previsti per impianti fotovoltaici con potenza superiore a 200kWp.
Dall’ udienza spalmaincentivi non sono state pubblicate le motivazioni della Consulta.
Assorinnovabili e Confagricoltura attenderanno la pubblicazione per decidere eventuali ricorsi a livello Europeo.
La Corte Costituzionale ha dichiarato infondata la questione di legittimità costituzionale dell’art. 26, commi 2 e 3, del decreto – legge 24 giugno 2014, n. 91 (convertito, con modificazioni, dalla legge 11 agosto 2014, n. 116), cd. “Spalmaincentivi”, nel settore dell’energia prodotta da impianti fotovoltaici.
Con il breve comunicato stampa (link a fine articolo) la Corte Costituzionale ha anticipato l’esito del ricorso sul cd. spalmaincentivi, ovvero sul provvedimento normativo che ha ridotto le tariffe incentivanti per impianti superiori con potenza superiore ai 200kWp, previste dalle convenzioni GSE.
Udienza spalmaincentivi – esito amaro per le rinnovabili
Alla vigilia le previsioni puntavano per un accoglimento del ricorso. Per questo motivo i due riccorrenti (Assorinnovabili e Confragricoltura) aspetteranno di leggere le motivazioni della sentenza per accordare un eventuale ricorso a Strasburgo.
Per gli operatori di settore l’applicazione dello spalmaincentivi avrebbe causato disparità di trattamenti tra gli operatori esclusi dal provvedimento (gestori di impianti con potenza inferiore ai 200kWp) e i proprietari di medio-grandi impianti che hanno subito il taglio, previsto nelle 3 opzioni.
Di opinione contraria la Consulta dopo la decisione del TAR del Lazio di depositare in Corte Costituzionale la pronuncia sull’illeggittimità costituzionale.
